Eric Gonzalez, a witness, who helped restrain Neely, as Penny restrained him, admitted, on the witness stand, that he had falsely told Police that Neely precipitated the incident by hitting him.[1]
Gonzalez testified he initially lied to Police because he was afraid he might face charges in Neely's death.[1]
In truth he didn't see the beginning of the incident.[1] He testified that when he entered the subway car Penny already had Neely in the chokehold, and he had his legs wrapped around Neely's body. Video of the incident confirms this. He testified he volunteered to pin Neely's arms, thinking that, if he did that, Penny could relax or release the chokehold.
Penny did not release the chokehold, until Neely went limp, and stopped struggling.[1] Gonzalez said he put Neely in the recovery position, but he did not recover, so "he walked away." No one tried to administer CPR.
Witness Alethea Gittings testified it did not look like Penny was choking Neely.[2] She testified that it looked like he was just holding Neely, "respectfully."
Other witnesses described how they had been frightened of Neely.[2] A mother with her child described trying to use her son's stroller as a barrier.
